Sexual Harassment
Too often, we have investigated and discovered alleged sexual harassment misconduct was false and the person making the allegation was out to make some money. In no way are we desensitized to the fact that true harassment claims are serious issues.
We recently concluded a case in which an employee claimed she was raped by a manager. This allegation was proven to be false. However, if it is happening, it is the company’s responsibility to act quickly and in an appropriate manner.
The EEOC (U.S. Equal Employment Opportunity Commission) defines sexual harassment as "Unwelcome sexual advances, requests for sexual favors, and other verbal or physical conduct of a sexual nature constitute sexual harassment when this conduct explicitly or implicitly affects an individual's employment, unreasonably interferes with an individual's work performance, or creates an intimidating, hostile, or offensive work environment."
AB 1825 (California's sexual harassment training law) was passed in late 2004, mandating sexual harassment training for California supervisors.
